1.1 The purpose of this AUP is to comply with the relevant laws of the Republic of South Africa (“The Republic”); to specify to customers and users of our services/website what activities and online behaviors are considered unacceptable; to protect the integrity of Izwi Technology Group (Pty) Ltd’s network; and to specify the consequences of such prohibited activities.
2.1 By accessing this website or contracting with Izwi Technology Group (Pty) Ltd for services, the User agrees, without limitation or qualification, to be bound by this policy and its terms, as well as any additional rules or policies displayed in connection with this service/website.
2.2 Izwi Technology Group (Pty) Ltd reserves the right to monitor the use of its network and resources and to bar or restrict access to any person or entity that violates this policy.
2.3 This AUP prohibits improper or abusive use of the network and provides enforcement and penalty mechanisms for violations.

2.5 This AUP forms part of Izwi Technology Group (Pty) Ltd’s Standard Terms and Conditions of Service.
3.1 Izwi Technology Group (Pty) Ltd respects the rights of users, including freedom of speech, privacy, human dignity, religion, belief, and opinion, as protected under the Constitution.
3.2 Izwi Technology Group (Pty) Ltd will not interfere with these rights unless required by law or where such rights are exercised unlawfully or in a way that threatens others or the integrity of the network.
3.3 The User acknowledges that Izwi Technology Group (Pty) Ltd cannot control all data passing through its infrastructure, including websites, emails, or other content accessible via its network. As such, Izwi Technology Group (Pty) Ltd is not responsible for transmitted data.
3.4 Izwi Technology Group (Pty) Ltd will take necessary actions to address any contraventions to protect the integrity of its network and resources.
3.5 Users are notified that Izwi Technology Group (Pty) Ltd is legally required to assist law enforcement agencies in investigations and prosecutions under a legal directive.
3.6 Users accessing external networks through Izwi Technology Group (Pty) Ltd’s network must comply with the AUPs of those networks.
3.7 Users residing outside the Republic are subject to the laws of their current residence. Izwi Technology Group (Pty) Ltd may assist foreign law enforcement agencies under legal obligation.
4.1 Izwi Technology Group (Pty) Ltd’s network, services, or resources may only be used for lawful purposes. Prohibited activities include, but are not limited to:
4.1.1 Creating or transmitting offensive, obscene, or indecent images or documents.
4.1.2 Violating domestic or international laws, including child pornography, hate speech, or discrimination based on race, gender, or religion.
4.1.3 Defaming, abusing, stalking, harassing, or threatening individuals.
4.1.4 Violating intellectual property rights, including copyrights and trademarks.
4.1.5 Using network resources to engage in unauthorized activities, including phishing and impersonation.
4.1.6 Committing fraud, illegal financial schemes, or transactions without consent.
4.1.7 Violating exchange control laws of the Republic.
4.1.8 Distributing illegal or pirated software.
4.1.9 Sending unsolicited mail after a recipient requests removal
5.1 Activities threatening the functioning, security, or integrity of the network are unacceptable and may result in criminal liability.
5.2 Izwi Technology Group (Pty) Ltd will investigate violations and cooperate with law enforcement when criminal activity is suspected.
5.3 To protect its network, Izwi Technology Group (Pty) Ltd reserves the right to:
5.3.1 Prevent unauthorized access, including hacking and cracking.
5.3.2 Restrict excessive or improper usage.
5.3.3 Prevent the spread of viruses, worms, or malicious code.
5.4 Bandwidth, storage, and service limitations may be revised at Izwi Technology Group (Pty) Ltd’s discretion without prior notice.
6.1 Izwi Technology Group (Pty) Ltd cannot control third-party content accessed via its network.
6.2 Users access such content at their own risk and are responsible for evaluating its appropriateness.
6.3 Izwi Technology Group (Pty) Ltd will not be liable for any loss or damage resulting from third-party content.
7.1 Spam and unsolicited mail are unlawful under the Electronic Communications and Transaction Act of 2002. Izwi Technology Group (Pty) Ltd prohibits:
7.1.1 Sending unsolicited bulk messages (spam).
7.1.2 Maintaining unauthorized mailing lists.
7.1.3 Using Izwi Technology Group (Pty) Ltd’s network for spam or public relay without authorization.
8.1 Webmail services are provided “as is” without warranties. Users are responsible for managing their data.
8.2 Webmail is for personal use only. Commercial or resale use is prohibited.
9.1 Izwi Technology Group (Pty) Ltd respects privacy and confidentiality in compliance with the Constitution and applicable laws. Users are encouraged to review Izwi Technology Group (Pty) Ltd’s privacy policy.
